This research project explores the scale and impacts of the unspent convictions rule enforced by the Criminal Injuries Compensation Authority (CICA). CICA delegate compensation to victims of violent crime in England, Scotland and Wales. However, the unspent convictions rule restricts individuals who have unspent convictions from being awarded compensation from CICA, except under exceptional circumstances. Rejection from compensation reflects how individuals who have unspent convictions are not seen as legitimate victims. Mixed methods will be used to explore this through the analysis of survey data alongside secondary data analysis of CICA’s statistics.
This research specifically aims to contribute towards positive change for survivors who have criminal records and hopes to contribute towards the argument to revise or remove CICA’s unspent convictions rule.
