A second chance to be heard: new rights for survivors

Screenshot from government website

The Government has announced a significant change to the way rape and serious sexual offence cases are reviewed.

From 13 July 2026, survivors across England and Wales whose cases are due to be dropped by the Crown Prosecution Service (CPS) will be able to request an early review by a different prosecutor before a final decision is made. If the second prosecutor concludes that the original decision was wrong, the prosecution can continue. The new process, known as the Early Victims’ Right to Review scheme, is intended to strengthen survivors’ confidence in the justice system by giving them an opportunity to challenge decisions before their case is formally ended.
